What if someone has written me a bad check?
I am supposed to be receiving a refund from a deposit my husband and I placed down on a building, however, there were nothing but problems so we decided along with the company to cancel the building and we would receive partial refund all except for the cost of the stamped blueprints. The problem now is that the company states they will not be sending a certified check so we are afraid the check could possibly bounce. I have never had to deal with anything like that before so I was just wondering what happens if the check does bounce. If we cash the check to later find out that it bounces does the bank deal directly with the company that wrote the bad check or do they make me pay back the funds or what. Also, what type of legal action can be taken if this happens and how exactly does collections work (I have read a few things on websites about sending it to collections). Thanks in advance!!
As the first poster stated, you sue them for it. Most civil courts will need a copy of the bounced check and any contracts that were signed showing that you are entitled to that money. Once you sue, they are issued the court date, if they don't show, you get a default judgement and can place a lien on any asset this company owns. You can also contact per the 2nd poster the bank and the bank will file a dispute against the company, most of the time the bank will refund you your money and put it in an investigation stage, then once they investigate, if they show you were due that money, nothing will be done, except they will have given your money back, if they show you are not entitled to the money, they can debit your account again for it. Before depositing the check, verify the funds with the bank. If the check bounces, you may be able to verify the funds a second time and if the funds are available be able to get a certified check cut to you once the funds are good. The fee for the certified check is under 10.00 and worth going to get your money. Check with your bank or the bank that the check is drawn off of. If it does come up NSF...contact your local civil court and find out what steps you need to take, in some cases, you have to go to a certain county to sue. Good Luck!
